Role of an Umpire

There are various roles for the Umpire one being appointed to assist the Arbitrator. An effective role that Jerry Margolius has played is that of an Umpire in matters of rental disputes.  The umpires mandate will emanate from the lease agreement and would usually become effective when:-

  • Landlord and Tenant have exhausted efforts to resolve their rental dispute;
  • Landlord and Tenant’s experts (Valuers) cannot resolve the dispute or require the intervention or assistance in concluding a rental.

The Umpires process will be discussed with the experts, but the Umpire unlike acting as an Arbitrator, can undertake his/her own investigations beyond the evidence that is provided by the experts. This conclusion may also be discussed before the Umpire makes a decision that is final and binding on the parties.  The process does not follow that in terms of the Arbitration Act 1965.
